A Will is one of the most important documents that you may prepare. A well written Will should give you peace of mind knowing that your wishes will take place and you have taken care of everyone. It is estimated that a large percentage of people in Scotland do not have a Will. If you do not have a valid Will then you are not in control of who receives your hard earned assets. You cannot assume your spouse, life partner or children will inherit everything. To die without a Will is to die “intestate”. Scots Law then determines who inherits your estate and there are costly and time consuming extra procedures to administer your estate if you do not have a valid Will.

There are 4 mains steps in administering an Estate where no inheritance tax is payable.

  1. Obtaining information as to all assets and debts.
  2. Preparing Inventory of assets to apply to the Sheriff Court for Confirmation (known as Probate in England) which is a legal document authorising the assets to be uplifted.
  3. Ingathering assets and paying debts.
  4. Distribution of assets to beneficiaries including any sale or transfer of property.
